These Terms and Conditions (“Terms”) govern the provision of services by Space Monkey Creative Limited (“we”, “us”, “our”) to you (“the Client”, “you”). By engaging our services, signing a proposal, or making payment, you agree to be bound by these Terms.

2. Services

Space Monkey Creative Limited provides creative and digital services including (but not limited to):

  • Brand identity and visual design
  • Website design and development
  • Motion design and animation
  • Video production and content creation
  • Ongoing design services and subscriptions

The scope, deliverables, timelines, and pricing will be defined in a written proposal, agreement, or subscription plan (“Project Agreement”).

3. Fees & Payment

  • All fees are quoted exclusive of VAT unless otherwise stated.
  • Payment terms are specified in the Project Agreement.
  • Unless agreed otherwise, invoices must be paid within 7 days of issue.
  • Late payments may result in paused work and/or additional fees.
  • We reserve the right to charge statutory interest and recovery costs on overdue invoices in accordance with UK law.

All deposits and subscription payments are non-refundable once work has commenced.

4. Project Timelines & Client Responsibilities

You agree to:

  • Provide accurate and timely information, content, and feedback
  • Respond to requests within reasonable timeframes
  • Approve deliverables promptly to avoid delays

Delays caused by the Client may result in revised timelines and additional costs.

5. Revisions & Amendments

Unless otherwise stated:

  • Reasonable revisions are included within the agreed scope
  • Requests outside the original scope may be quoted separately
  • Excessive or fundamental changes may be treated as a new project

6. Intellectual Property

6.1 Ownership

  • Final deliverables become the Client’s property only after full payment has been received
  • Until payment is complete, all work remains the property of Space Monkey Creative Limited

6.2 Usage

We retain the right to:

  • Display completed work in portfolios, websites, case studies, awards, and marketing materials
  • Reference the Client name and project description for promotional purposes

7. Third-Party Services

We are not responsible for:

  • Hosting providers, domain registrars, plugins, fonts, or third-party software
  • Service outages, security breaches, or changes imposed by third parties

Any third-party costs are the Client’s responsibility unless explicitly included.

8. Cancellations & Termination

8.1 By the Client

  • Projects may be cancelled with written notice
  • Fees for work completed up to the cancellation date remain payable
  • Deposits and subscription fees are non-refundable

8.2 By Space Monkey Creative Limited

We reserve the right to terminate services if:

  • Payments are overdue
  • The Client breaches these Terms
  • The working relationship becomes unworkable or abusive

9. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, consequential, or loss-of-profit damages
  • Our total liability is limited to the fees paid for the relevant services

Nothing in these Terms limits liability for death or personal injury caused by negligence.

10. Confidentiality

Both parties agree to keep confidential information private unless disclosure is required by law or consent is provided in writing.

11. Force Majeure

We are not liable for delays or failure to perform due to events beyond reasonable control, including but not limited to acts of God, strikes, pandemics, or technical failures.

12. Governing Law

These Terms are governed by the laws of England and Wales, and the courts of England shall have exclusive jurisdiction.

13. Amendments

We reserve the right to update these Terms at any time. The most current version will always be available on our website.
